Kamal Maihouane was niet de eerste ‘loterij loser’in Nederland en ook niet eens de grootste ‘loterij loser’ van Nederland. In 2002 liep een man uit Roermond € 11.500.000 mis, toen de jackpot viel op de nummers waar hij altijd mee speelde, maar hij niet deel bleek te nemen doordat de Rabobank de incasso had teruggedraaid, omdat de beste man wat kleingeld tekort kwam op zijn bankrekening.
Deze man spande vervolgens een procedure aan tegen de Rabobank, omdat hij vond dat de Rabobank de incasso ten onrechte had teruggedraaid. Zonder teruggedraaide incasso, zou de man gewoon mee hebben gedaan aan de Sponsorloterij en als hij gewoon zou hebben mee gedaan aan de Sponsorloterij, zou hij € 11.500.000 gewonnen hebben. Kortom: allemaal de schuld van de Rabobank.
Rabobank draait incasso terug in verband met overschrijding limiet
Net zoals Maihouane, deed deze man met vier loten mee. Dit kostte destijds € 20 per trekking en dit bedrag werd door de Sponsorloterij maandelijks van de bankrekening geïncasseerd. Deze incasso gebeurde telkens tussen de 22e en de 31e van de maand. Niet geheel toevallig, de periode waarop salarissen, studiefinancieringen en uitkeringen worden gestort, maar dat terzijde.
Met de Rabobank had de loterijdeelnemer afgesproken dat hij € 1.361,34 rood mocht staan. Dat was kennelijk niet genoeg, want op 13 november 2002 stond de beste man € 1.835,86 rood. Toen vond de Rabobank het wel weer welletjes geweest en stuurde de bank de man een brief dat hij zijn roodstand had overgeschreven en dat zijn rekening en betaalkaarten werden geblokkeerd. Ook werd de beste man er per brief op gewezen dat eventuele automatische incasso’s teruggedraaid zouden worden in verband met onvoldoende saldo.
Kosten van loten niet geïncasseerd
Vervolgens schoot de Rabobank direct in actie. Op 14 november 2002 werden maar liefst 7 automatische incasso’s die eerder waren gedaan gestorneerd (teruggedraaid), waardoor de roodstand € 500,50 lager werd. De loterij loser boekte op die dag ook een bedrag van € 160 over vanaf zijn spaarrekening naar zijn betaalrekening.
Op 22 november 2002 probeerde de Sponsorloterij de € 20 voor de loten voor de trekking van 14 december 2002 te incasseren. Dat lukte niet, omdat de rekening van de ‘loterij loser’ nog was geblokkeerd voor incasso in verband met het overschrijden van het maximale bedrag dat rood gestaan mag worden. Niet betalen betekent natuurlijk niet meedoen aan de trekking.
Op 29 november 2002 werd het salaris (€ 1.319,29) van de man bijgeschreven, waardoor hij weer even niet rood stond: € 143,93 in de plus bedroeg het banksaldo na het storten van het salaris. Voor de Rabobank was dit redenen om de incassoblokkade ongedaan te maken, waardoor er weer geïncasseerd kon worden.
Op 14 december 2002 was vervolgens de trekking van de Sponsorloterij. Deze loterij loser deed niet mee, omdat hij zijn loten niet had betaald. Je ziet het van kilometers ver aankomen: de jackpot van € 11.500.000 viel uiteraard op de getallen en kleuren waar de ongelukkige man uit Roermond altijd mee speelde. Volgens deze man de schuld van de Rabobank, waardoor hij € 11.500.000 misgelopen jackpot, € 75.000 gemaakte kosten voor een procedure tegen de Sponsorloterij en € 25.000 voor een procedure tegen Interpay, het bedrijf dat de incasso’s verzorgt.
Rechter oordeelt dat deze man een eigen verantwoordelijkheid heeft
De rechter ging niet bepaald mee in het “Het is iedereen zijn schuld behalve de mijne”-betoog van deze man. De Rabobank had volkomen gelijk toen het de rekening van de man blokkeerde voor incasso. De man had immers de afgesproken roodstand fors overschreden.
Ook het betoog van de man dat de Rabobank na de storno (het terugdraaien) van een zevental incasso’s de blokkade ongedaan had moeten maken, werd niet gevolgd door de rechter. Er was immers – na telefonisch overleg – afgesproken dat de blokkade pas na het storten van het salaris weer ongedaan gemaakt zou worden. De incasso van de € 20 voor de Sponsorloterij was toen al mislukt. Na het storten van het salaris, heeft de Rabobank de incassoblokkade weer opgeheven, waardoor de Rabobank aan haar deel van de afspraak heeft gedaan.
De Rabobank en de rechter stellen ook dat de man tussen het moment van het ontvangen van de brief van de Rabobank en de trekking, een tijdsbestek van meer dan 2 weken (!!), meer dan voldoende tijd heeft gehad om bij de sigarenboer dan maar wat loten te kopen of op een andere manier de Sponsorloterij te betalen, zodat hij mee kon doen aan de trekking van 14 december 2002.
Bij de rechter ving de man bot en ook in hoger beroep wist hij de rechtbank niet te overtuigen van zijn gelijk. In 2007 ging hij nogmaals in cassatie. Gevolg: geen € 11.500.000, maar wel voor tienduizenden euro’s proceskosten!
