Ze was echter niet op de hoogte van het feit dat haar naam openbaar zou worden gemaakt. Dit is namelijk vastgelegd in New Hampshires ´Right to Know´-wet. Toen Doe hiervan op de hoogte werd gebracht door een advocaat, diende zij een klacht in bij het Superiour Court van New Hampshire.
In haar verzoek schreef Doe dat ze een oude inwoonster is van New Hampshire en zeer betrokken is bij de gemeenschap. Ze wenst dit werk, ook na het winnen van deze enorme geldprijs, gewoon voort te kunnen zetten.
Daarnaast is het voor haar belangrijk dat ze een supermarkt binnen kan lopen of een openbaar evenement kan bezoeken zonder dat ze herkend wordt als de winnares van een half miljard Dollar. Doe vroeg aan de loterijcommissie om haar naam wit te maken en vertrouwen te creëren bij het publiek. Dit vertrouwen kan volgens haar gebruikt worden als identificatie van haar persoonlijke informatie.
Makkelijk voorkomen
Toen Doe wist dat ze de jackpot gewonnen had, tekende ze haar lot met haar naam en zette haar handtekening. Hierdoor kan de loterij echter niet langer garanderen dat ze ook anoniem blijft. Dit had ze vrij makkelijk kunnen voorkomen.
Hoe? Door het lot op naam van een stichting te zetten. In dat geval was de winnares zelf anoniem gebleven. In de rechtszaal kondigde Doe aan dat dit inderdaad een enorme fout van haar is geweest. Zo had ze dit hele proces namelijk vrij makkelijk kunnen voorkomen.
Diskwalificatie
De winnares van de loterij kan er wel voor kiezen anoniem te blijven. Dit brengt echter wel een groot nadeel met zich mee: Doe kan gediskwalificeerd worden. In de regels van de loterijcommissie is namelijk opgegeven dat winnaars bekend moeten worden gemaakt.
Dit zou natuurlijk een bijzonder vervelende bijkomstigheid zijn voor de winnares. De rechter moet nog uitspraak doen, maar Doe laat het vast niet zo ver komen dat zij gediskwalificeerd wordt en dus een half miljard Dollar misloopt.
Hoe zit dit in Nederland?
In Nederland is het bij veel loterijen wel mogelijk anoniem te blijven. Zo besloot de Lotto ongeveer tien jaar geleden al dat winnaars van grote prijzen niet meer met naam en toenaam in de publiciteit komen. Op deze manier worden winnaars beschermd tegen bijvoorbeeld afpersers.
Ook de Staatsloterij biedt winnaars de mogelijkheid anoniem te blijven. De winnaars van deze loterij kiezen zelf of zij hun gegevens openbaar willen maken. Bij de Nationale Postcode Loterij wordt bij winnaars vaak een camera onder de neus gedrukt. Al gebeurt dit ook alleen wanneer mensen dit zelf willen. Wanneer zij dit niet willen, hoeft dit echter niet.
