Jackpot voor de Belgische Nationale Loterij. 1,2 miljoen euro, zo hoog is de boete die de Nationale Loterij heeft gekregen van de Belgische Mededingingsautoriteit. Scooore
‘Scooore’ is het product van de Nationale Loterij waarbij deelnemers in kunnen zetten op de uitslagen van sportwedstrijden. Net zoals dit kan via de websites van de vele private kansspelaanbieders met een FA+-vergunning (de vergunning voor het aanbieden van (online) weddenschappen). Voorbeelden van dit soort partijen zijn Ladbrokes, Betway, Betfirst en sinds kort ook Casino 777. De Nationale Loterij haalt haar omzet voornamelijk binnen via krantenwinkels.
Eigenaren van krantenwinkels worden flink onder druk gezet om de loten en weddenschappen van de Nationale Loterij aan de man te brengen. Dit tot ongenoegen van private partijen in de markt van (online) weddenschappen.
In januari 2013 ging de Nationale Loterij over de schreef bij het versturen van e-mail om het spel ‘Scooore’ te promoten. Het viste hiervoor e-mailadressen uit ’n databank waarin gegevens stonden die enkel en alleen verzameld konden worden dankzij het wettelijke monopolie van de Nationale Loterij en die zeker niet bedoeld waren om weddenschappen te promoten. Doordat de concurrentie niet over deze gegevens kon beschikken, was de Nationale Loterij in overtreding.
Informatie onrechtmatig verkregen via de Belgische overheid
In 2011 en 2013 heeft de Nationale Loterij ook nog eens gevoelige informatie over de concurrentie opgevraagd bij de overheid. Deze informatie werd ook nog eens verstrekt door de overheid.
De totale boete bedraagt 1,3 miljoen euro, maar daar gaat 10% vanaf omdat de Nationale Loterij braaf meewerkte aan het onderzoek, schuld heeft bekend en de sanctie heeft aanvaard. Of de Nationale Loterij er veel van heeft geleerd is maar de vraag. De woordvoerder dan de Nationale Loterij bagatelliseert het namelijk wat met de woorden “We aanvaarden de boete voor twee kleine inbreuken op de mededingingswetgeving die strikt beperkt waren in die tijd”.
De Nationale Loterij had deze boete al voorzien en het stroppenpotje wat bijgevuld. Daardoor heeft deze boete geen negatief effect op de jaarcijfers van de Nationale Loterij.
Echt veel lijkt de Nationale Loterij er niet van geleerd te hebben…
Scooore is 15 januari 2013 van start gegaan via krantenwinkels. 29 juli 2013 was bovendien ook de start van het aanbieden van Scooore via internet. Mei 2013 ging het (lotto)balletje rollen door klachten tegen de Nationale Loterij van Stanley Bet, Sagevas, WFA en PMU bij de Mededingingsautoriteit. De Mededingingsautoriteit opende hierop een onderzoek en verrichtte de nodige huiszoekingen in de kantoren van de Nationale Loterij.
De Nationale Loterij gooit er vervolgens nog wat gladde marketingteksten die als ’n tang op een varken slaan: “Met Scooore blijven we een duurzaam alternatief aanbod van sportweddenschappen promoten tegenover een agressiever aanbod door grote buitenlandse multinationals die hun zetel hebben in bijvoorbeeld Malta”.
Een onvervalst stuk populisme. De houders van een FA+-vergunning om weddenschappen aan te bieden aan inwoners van België, betalen allemaal in België belastingen en kansspelbelastingen over hun omzet. Agressiever dan het onder druk zetten van krantenverkopers, is de marketingtactiek van deze “buitenlandse” bedrijven zeer zeker niet.
De Belgian Betting Association (BBA) is tevreden met de boete die is opgelegd aan de Nationale Loterij. De BBA is een overkoepelende organisatie van bedrijven die weddenschappen en gokspellen aanbieden op de Belgische markt. De BBA vindt wel dat het machtsmisbruik van de Nationale Loterij verder gaat dan de Mededingingsautoriteit in wil zien.
